What probate services do we provide?

We carry out the work for obtaining probate in cases where the deceased has left a valid will or letter of administration (with or without a will) and for the appointment of administrator by the court. However, we do not undertake estate administration work.

Applying for the grant of probate

We anticipate this will take between 10 to 15 hours of work at £189.00 per hour plus VAT at 20%. Total cost is estimated to be £1,890.00 – £2,835.00 plus VAT (20%).

The exact cost will depend on the individual circumstances of the matter. For example, if there is one beneficiary and no property, costs will be at the lower end of the range. If there are multiple beneficiaries, a property and multiple bank accounts, costs will be at the higher end. We will handle the full process for you. Our above cost estimate is for estates where:

  • There is a valid will.
  • There is no more than one property.
  • There is no more than 1 bank or building society account.
  • There are no other intangible assets.
  • There is 1 beneficiary
  • There are no disputes between beneficiaries on the division of assets. If disputes arise, this is likely to lead ot an increase in costs.
  • There is no inheritance tax payable, and the executors do not need to submit a full account to HMRC.
  • There are no claims made against the estate.

Disbursements not included in this fee (where applicable VAT is included at 20%)

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

  • Probate application fee of £273.00.
  • Swearing of the oath (£2.00 per executor)
  • Bankruptcy-only Land Charges Department searches (£2.00 per beneficiary)
  • Notice to be posted in The London Gazette £87.30 plus VAT (20%) - Protects against unexpected claims from unknown creditors.
  • Notice Posted in a Local Newspaper £240.00 plus VAT (20%) - This also helps to protect against unexpected claims.

Potential additional costs

  • If there is no will or the estate consists of any share holdings (stocks and bonds), there are likely to be additional costs that could range significantly depending on the estate and how it is to be dealt with. We can give you a more accurate quote once we have more information.
  • If any additional copies of the grant are required, they will cost £1.50 (1 per asset usually).
  • Dealing with the sale or transfer of any property in the estate is not included.

What services are included in our fixed fee?

As part of our fixed fee, we will:

  • Provide you with a dedicated and experienced probate solicitor to work on your matter.
  • Identify the legally appointed executors or administrators and beneficiaries.
  • Accurately identify the type of probate application you will require.
  • Obtain the relevant documents required to make the application.

How long will this take?

We will normally be able to submit the probate application within 2-3 weeks of you instructing us and providing all the required documents, but we will let you know if it is likely to take longer than this. The grant of probate is usually issued within 16 weeks of submission of the application.

Debt Recovery Fees

In most matters, we will provide you with our hourly rate and a cost estimate at the outset. However, this may be revised depending on the nature and complexity of the case.

Our hourly rates (plus VAT)

Our hourly rates (plus VAT)
Position Rate
Solicitor (Over 4 years experience) £333.00 (+ 20% VAT)
Solicitor (1-4 years experience) £189.00 (+ 20% VAT)
Paralegal £134.00 (+ 20% VAT)

What debt recovery services do we provide?

We provide information regarding debt recovery for amounts up to £100,000.00, specifically for cases involving undisputed unpaid invoices where no enforcement action is necessary.

In case the opposing party disputes the claim, we will discuss any additional work needed and may adjust the debt recovery costs. Additional work could be covered by a fixed fee, such as for an extra letter, or an hourly rate for more extensive tasks.

The initial fixed fee is £400.00 plus VAT (£80.00) – Total £480.00. This covers:

  1. Taking your instructions and reviewing documentation.
  2. Conducting appropriate searches.
  3. Sending a letter before action.
  4. Receiving any payment and forwarding it to you.

If there’s no response to the letter before action, an additional fixed fee of £1,000.00 plus VAT (£200.00) - Total £1,200.00 covers:

  1. Drafting the claim form and particulars of the claim.
  2. Issuing the claim at court.
  3. Applying to the court for judgment in default of a defence when no acknowledgement of service or defence is received.
  4. Writing to the other side upon receiving judgment in default to request payment.
  5. Providing advice if payment is not received within the specified time.

Our fixed fees exclude disbursements, any payments to third parties on your behalf, notably the court fee for issuing a claim.

Disbursements (not included in costs set out above)

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. For undisputed debt claims, there does not tend to be any disbursements, other than court fee for issuing the claim if legal proceedings are needed. If a payment to a third party is required, we will notify you as to the reason and amount in advance.

Court Fees

Court Fees
Debt Value Court Fee
Up to £5,000 From £35
£5,001 – £10,000 From £455
£10,001 – £100,000 5% value of the claim

It's important to note:

  • For claims of £10,000.00 or less, you can't recover legal fees, even if successful.
  • Interest and compensation may increase costs.
  • The quoted fees don't cover enforcement actions like instructing bailiffs or the Sheriff.

Our fixed fees apply to straightforward, undefended debt recovery matters. A revised cost estimate will be provided if the case falls outside this scope.

How long will this take?

Undisputed Debt Recovery matters can take between 2 weeks to 6 months, from receipt of instructions from you to receipt of payment from the other side, depending on whether or not it is necessary to issue a claim form at court. Our fees are also based on the other side paying promptly on receipt of default judgment (where they have not defended a claim form). If enforcement action is needed as they do not settle the judgment, the matter will take longer to resolve and will involve further fees. This is just an estimate, and we will of course be able to give you a more accurate timescale once we have more information and as the matter progresses.
